These Terms of Service (“Terms”) govern your access to and use of Mavity (doing business as PromptForge), a service for uploading, storing, organizing, version-controlling and sharing AI prompts (the “Service”), provided by:

By creating an account, accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service.
By using the Service you confirm that you meet this age requirement and have the legal capacity to agree to these Terms (or that you have parental/guardian consent where required by law).

2. Your Account

You create an account via Google or email/password.
You are responsible for keeping your login details secure and for all activity under your account.
Notify us immediately of any unauthorized use.

We may suspend or terminate accounts for violations of these Terms.

3. The Service

The Service lets you upload, store, organize, version-control and share text-based AI prompts.
No AI execution, generation, analysis or training takes place in the app.
API call limits depend on your plan: Starter (10,000/month), Pro (100,000/month), Business (500,000/month).
No export feature is currently available.

We may update, modify or discontinue features at any time.

4. Your Content (Prompts)

You retain full ownership of the prompts and other content you upload (“User Content”).

By uploading User Content, you grant us a limited, worldwide, royalty-free license to store, host, display and make it available solely to provide the Service (including any sharing features you choose to use).

You promise that your User Content does not infringe third-party rights and does not violate any law.

We are not responsible for any misuse of your prompts in external AI tools.

5. Acceptable Use

You may not use the Service to:

Upload content that infringes intellectual property rights or violates laws
Upload illegal, harmful, defamatory or abusive material
Attempt to reverse engineer, hack or overload the Service
Exceed usage limits in a way that disrupts the Service
Send spam or malicious code

We may remove content or suspend access if we reasonably believe these rules are violated.

6. Subscriptions & Payments

We offer monthly subscriptions starting at $9/month (Starter), $29/month (Pro), and $49/month (Business). Current prices are shown on the site.
Payments are processed securely via Stripe. Subscriptions auto-renew until cancelled.
All fees exclude applicable taxes (including Dutch VAT where required – we collect VAT as mandated by law).

New accounts are eligible for a 14-day free trial. During the trial you have full access to the Service at no charge. One trial is available per account, you cannot claim multiple trials by re-subscribing or creating new plans. After the trial period ends, your subscription automatically converts to a paid monthly subscription at the current price unless you cancel before the trial expires.

No refunds are currently offered, except where required by law (e.g. 14-day cooling-off for Dutch/EU consumers).
Non-payment may result in suspension of your account after 7 days.

We may change prices with at least 30 days' notice by email.

7. Intellectual Property

We (or our licensors) own the Service, code, design and any non-user content.
You may not copy, modify or create derivative works of the Service.

8. Privacy & Data Protection

We collect limited personal data: email, chosen username, payment details (via Stripe), and API usage logs.
Data is processed in line with GDPR. For full details see our separate Privacy Policy.

We use third-party processors: Stripe (payments), Vercel (hosting), Neon.tech (database). International transfers may occur; appropriate safeguards (e.g. Standard Contractual Clauses) are in place.

To exercise your GDPR rights (access, correction, deletion etc.), email us at [email protected]. We respond within the statutory period.

9. No Warranties – Service “As Is”

The Service is provided “as is” and “as available” without any warranties. We do not guarantee uninterrupted access, error-free operation or specific uptime.

We aim for good availability but offer no formal SLA or uptime credits at this time.

10. Limitation of Liability

To the maximum extent permitted by Dutch law, our total liability is limited to the amount you paid us in the 12 months before the claim.
We are not liable for indirect, consequential, lost profits or data loss damages.

You agree to indemnify us against claims arising from your User Content or violation of these Terms.

11. Termination

You may cancel your subscription/account at any time (access continues until end of paid period; no refunds).
We may suspend or terminate your access for serious violations, with notice where reasonable.

Upon termination, your prompts and account data will be deleted (no export available).

12. Changes to Terms

We may update these Terms. Material changes will be notified by email at least 30 days in advance. Continued use after the effective date means acceptance.

13. Governing Law & Disputes

These Terms are governed by Dutch law.
Any disputes shall be submitted to the competent courts in the Netherlands.

Online Dispute Resolution

If you are a consumer in the EU, Norway, Iceland, or Liechtenstein, you may use the European Online Dispute Resolution (ODR) platform to resolve disputes related to online purchases: https://ec.europa.eu/consumers/odr. Our email address for ODR purposes is [email protected].

14. Miscellaneous

These Terms constitute the entire agreement. If any part is invalid, the rest remains effective.
No waiver of any breach is a waiver of future breaches.
